This Terms and Conditions document governs the use of The 'Top Class Gears' (TCG hereafter) Web Store Service. This Agreement can be accessed through T&C at the lower section of the website.
Terms and Trade
TCG owns and operates this website www.topclassgears.com, and is located in New Zealand. TCG operates under New Zealand laws.
ACCEPTANCE OF TERMS
When you access this site, you acknowledge that you have read and agree to the terms described below. If you do not agree to the terms discussed here, you should exit the site and refrain from placing any order.
CONTRACT, PAYMENT AND DELIVERY
Orders will be accepted by TCG, for delivery in New Zealand only. Payment is to be made in NZ currency. Any contract arising from this site is governed by the laws of New Zealand.
Product specifications may vary from what is advertised.
Products may be added to or removed from the website from time to time. While we do not accept liability for any loss arising, every effort will be made to keep the information up to date and accurate.
All prices on the website are in New Zealand dollars (NZD) and includes Goods and Services Tax (GST). Prices may increase or decrease from time to time. Prices shown at the time of purchase are the prices you will pay. You must pay by payment methods available on the website. We will not accept cheques or cash on delivery. TCG takes no responsibility for pricing mistakes etc.
Products displayed on TCG shopping site can be purchased using secure online Mastercard and Visa transaction facility.
TCG reserves the right to abort a sale at any point.
TCG do not collect or store any credit card information.
You cannot order online from our partner stores and not all products are available.
All payments made by puchase order (Charge accounts) are subject to individual approval.
You will be asked to register as a member of TCG. Apart from the many member benefits, including receiving regular emails containing special deals, your shopping address details will be filed saving you the effort of entering these details each time you go to the checkout.
As a registered customer we will send you emails and updates from time to time to inform you of new ranges, special offers and discounts. Please note, you are able to unsubscribe from our email updates at any time.
You cannot cancel your order once it has been placed. Please contact your dispatch store as soon as possible if you need to make changes to your order.
We will not deliver to a Post Office box or any address in which we deem suspicious. We ship our goods from our local warehouse.
Generally, products are dispatched the next working day but may take up to 14 days to be delivered. Please contact us if you have not received your product within this time.
We will notify you if your product cannot be dispatched.
Delivery charges will be added to each order and shown as a separate item before you chose to enter your payment details and send the order to be processed within New Zealand.
Should your order incur an additional charge, we will advise you prior to processing your order.
Should you feel that your goods do not arrive in good condition, please feel free to contact us.
We are not responsible for loss or damage of goods that are delivered to an incorrect address.
TITLE AND RISK
Goods are at our risk until delivered to the address given for your purchase.
RETURNS AND REFUNDS
Please choose carefully as we do not refund if you change your mind. If you discover any defect with your product, you may return the item you purchased in new condition for repair or replacement within 30 days of delivery. For faulty products we may, at our discretion, and/or if the supplier has a policy, for repair the product or provide a complete refund. We will notify you via e-mail of the status of the replacement, repair or refund once we have received and processed the returned item. You can expect a refund in the same form of payment originally used for purchase within 7 business days of our receiving your return. Different manufacturer / supplier may offer different options / procedures for repair, details can be found along with the description of the goods.
Freight will be refunded where the product is faulty or arrived damaged.
Under our guarantee, faulty items that meet our conditions of care and use will be repaired, replaced or a refund will be issued at TCG's discretion.

Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.
Our warranties cover manufacturing defects, please note that the guarantee does not cover faults arising from:

Accidental damage or mistreatment

Warranty does not cover indirect or consequential damage resulting from the defects or inaccuracy or inoperativeness of the product.
Warranties shall not apply if products are bought for use by a hire company.
LIMITATION OF LIABILITY
TCG are not liable for any direct, indirect, special, incidental or consequential damages or loss of profit arising out of the use, or the inability to use, the products on this site. This includes but is not limited to the loss of data or loss of profit, even if TCG was advised of the possibility of such damages.
